V8 Supercar governing body AVESCO has successfully sued one its Hall of Fame champions, Bob Jane.
The District Court of New South Wales yesterday found in favour of AVESCO in its long-running legal dispute with Jane’s Calder Park Motorsport Promotions (CPM), ordering them to pay all legal costs on an indemnity basis.
AVESCO claimed CPM failed to pay the sanctioning fee for the 2001 Calder Park round of the championship.
CPM denied it owed the money and unsuccessfully cross-claimed against AVESCO.
AVESCO dumped Calder Park from the 2002 championship, terminating an agreement with CPM due to the late payment.
At the time, Jane claimed the bill had been delivered to the wrong address and AVESCO was using it as an excuse to exclude Calder Park from the series.
AVESCO Chairman Tony Cochrane yesterday said he “did not appreciate” Jane avoiding his obligations.
“We are pleased that the Court not only found in our favour, but also took the fairly unusual step of awarding indemnity costs against Calder Park Motorsport Promotions,” he said.
"I do not necessarily like litigation, but I am not afraid to take strong action against people or organisations who do not honour their commitments to AVESCO.”
Jane continues to be a supporter of the V8 Supercar series, with his Bob Jane T-Marts in the middle of a three-year contract as naming-rights sponsor of the Bathurst 1000.
A four-time national touring car champion, Jane was inducted into AVESCO’s Hall of Fame in 2000.
